Terms of Use

These Terms of Use ("Terms") are an agreement between you and Anand Ram Verma ("we", "us"), the developer of the Balajii Automation app. They cover the app, your account, and the online services that let the app control your Balajii smart-home devices (together, "the Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Our Privacy Policy explains how we handle your data, and is part of these Terms.

1. The Service

• The app lets you set up Balajii devices on your home Wi-Fi and control them from your phone.
• Using it needs an account, an internet connection, and online services we use to run it (see section 7).
• These Terms cover the app and the Service only. Buying a Balajii device is covered by the terms of sale where you bought it.

2. Your account

• You must give a real email address you can access, and verify it before using the Service.
• Keep your password private. You're responsible for everything done with your account.
• Tell us straight away at the address below if you think someone else has used your account.
• You can delete your account at any time, in the app or at balajiautomationai.com/delete-account.

3. Who can use the Service

By using the Service, you confirm that:

• you're at least 18, or the age of majority where you live, and able to agree to these Terms; or a parent or guardian who has agreed to them lets you use the Service under their supervision;
• the information you give us is true and kept up to date;
• you won't access the Service through bots, scripts or other automated means, except the app itself;
• you'll only use the Service lawfully, and only to control devices you own or are allowed to control.

4. Intellectual property

The app, its software, design, text, graphics and logos, and the software on Balajii devices, belong to us or our licensors and are protected by intellectual-property laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app to control your own devices, in line with these Terms. You don't get any other rights to them.

5. What you must not do

• Copy, modify, decompile, reverse engineer or extract the source code of the app or of the software on Balajii devices, except where the law expressly allows it.
• Get around, disable or interfere with the Service's security, such as its sign-in, device ownership checks or access rules.
• Access or control another person's account or devices without their permission, or try to.
• Impersonate anyone, or misrepresent your connection to anyone.
• Overload, disrupt or attack the Service or the networks it runs on, or send it malicious code.
• Use the Service for anything illegal, harmful or abusive.
• Sell, rent or otherwise make the Service available to others as a service of your own.

6. Feedback

If you send us ideas, suggestions or feedback about the Service, you agree we may use them freely, without paying you or owing you anything. Please don't send us anything confidential.

7. Third-party services

The Service relies on providers who run parts of it for us:

• Google (Firebase and Google Cloud): sign-in, account and device records, server functions and this website (United States).
• EMQ Technologies (EMQX Cloud): the messaging service between the app and your devices (Singapore).

We aren't responsible for third-party websites or services we link to or rely on, or for their content, availability or policies. Your use of them may also be governed by their own terms.

8. Device and electrical safety

• Balajii devices switch electrical appliances. Installation and wiring must be done by a qualified electrician, following local electrical rules and the device's instructions.
• Commands sent through the app depend on your internet connection, your home Wi-Fi and online services. They can be delayed, or not arrive at all.
• Don't use the Service to control anything where a delayed, missed or unintended switch could cause injury, death, or serious damage — for example medical or life-support equipment, or safety-critical systems.

9. Managing the Service

We may, but don't have to:

• monitor the Service for breaches of these Terms;
• take action against anyone who breaches them, including suspending or closing their account;
• change, suspend or stop any part of the Service, with notice where reasonably possible;
• do whatever else is reasonably needed to protect the Service, our users and their devices.

10. Your data

• How we collect, use and delete data is described in our Privacy Policy.
• We don't guarantee backups of any data. Settings stored only in the app on your phone are removed when you sign out, delete your account, or uninstall the app, and can't be recovered.
• You're responsible for the data you enter, such as device names.

11. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, timely, secure or error-free. Nothing in these Terms limits any rights you have by law that can't be limited.

12. Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of, or inability to use, the Service — including commands that are delayed or don't arrive. Nothing in these Terms excludes liability that can't be excluded by law.

13. Indemnity

You agree to cover any claims, losses or costs (including reasonable legal fees) that arise from your breach of these Terms or your misuse of the Service.

14. Ending these Terms

• These Terms apply for as long as you use the Service.
• You can stop at any time by deleting your account.
• We may suspend or close your account if you breach these Terms, or if we have to by law.
• When your account is deleted, your devices stop connecting to the Service until they're set up again with an account.
• Sections 4, 6 and 10–16 continue to apply after these Terms end.

15. Changes to these Terms

We may update these Terms. We'll post the new version on this page and change the effective date above. If you keep using the Service after a change, you accept the updated Terms.

16. General

• Governing law: these Terms are governed by the laws of India.
• Whole agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the Service.
• Severability: if any part of these Terms can't be enforced, the rest still applies.
• No waiver: if we don't enforce a right, we haven't given it up.
• Assignment: you can't transfer your rights under these Terms. We may transfer ours, for example if the Service is taken over by someone else.
